Most people who have working VISA in Japan have to wait for at least 10 years to get PR since you enter to Japan with legal status. If you graduate from a University or Senmon-Gakko in Japan, you need to spend at least 5 years to apply for PR. Some applicants could get PR with a few years living experience when their Spouses are Japanese or Permanent Residents or Special Permanent Residents.
But here is the story that might surprise you. There is the chance to get Permanent Residency for 1 years living in Japan even if your Spouses are not Japanese or has no Permanent Residency. What you need to have is your academic diploma, license, profession and good income. There is the VISA which give you so much flexibility and give you the chance to get PR for 1~3 years living in Japan.
That is named Highly Skilled Professional, the ticket for earlier application to live in japan permanently. In this article, I'll show you how your professional life work for you to get the flexibility other foreign citizens doesn’t have and your PR application earlier stage in your life.
What is the Highly Skilled Professional VISA (HSP)?
Before giving explanation about the VISA, you need to understand what is HSP. There are 4 types of HSP as following.
Advanced academic research activities
Working for an institute in Japan to engage in research, instruction for research and education (Research Activity), and managing business which is relative the research activity as you engage in the Research Activity or engaging in research activity for another institute.
Advanced specialized/technical activities
Working for an institute or business in Japan to engage in the activity which require your knowledge of natural science or humanities or technology (Professional Activity) or
Advanced business management activities or managing the business which is relative to Professional Activity as you engage in Professional Activity.
Advanced business management activities
Managing or administrating business in Japan (Management Activity) and run your own business which is relative to the Management Activity.
HSP 2nd
This VIS is issued for someone who’ve already get other types of HSP and engage in the activity designated on their current HSP VISA.
So much flexibility
If you get HSP VISA, you have huge merits in terms of flexibility on VISA status. Usually if you get working VISA, you are only allowed to engage in the activity which is designated on your VISA. If you have engineer VISA, you can’t start your own business while you still work for the VISA sponsor.
But if you get HSP VISA, you could work for an institute which sponsor your HSP VISA and start your own business if the business is relative to what you’ve engage in for your VISA sponsors.
If you get HSP 2nd, you also get so much merits with the VISA. Your Spouses are also allowed to work without getting work permit and could give your parents and house keepers from outside of Japan VISA with certain condition.
Getting Permanent Residency for 1 or 3 years.
This cold be one of the strongest merits for HSP holders. Usually you need to wait for 10 years to apply for Permanent Residency and have 3- or 5-years Term of Period. Since you have 5 years or has no limit on Term of your VISA status, you automatically meet “having 3- or 5- years Term of Period”.
The guideline for Permanent Residency from the Ministry of Justice(Advanced business management activities) also have exceptional rules on HSP holders as followings.
1. If you have more than 70 points based on the calculation by using Point Sheet for HSP VISA, you need to live in japan continuously as Highly Skilled Professionals for more than 3 years.
2. If you have more than 80 points based on the calculation by using Point Sheet for HSP VISA, you need to live in Japan continuously for more than 1 year.
Even you don’t have HSP VISA, you have the chance to get PR earlier
Some people has more than 70 or 80 points based on the Point Sheet but does not HSP VISA. But here is the good news for you. The Guideline also has the rules as followings,
1. If you have more than 70 points 3 years before from the date the application of Permanent Residency is submitted, you need to live in Japan continuously for more than 3 years.
2. If you have more than 80 points 1 years before from the date the application of Permanent Residency is submitted, you need to live in Japan continuously for more than 1year.
So even you don’t have HSP VISA, you have chance to get PR within a few years.
